The following describes the terms on which AdjustTheVote.org offers you access to our website.

Introduction

Welcome to AdjustTheVote.org. By using the services on the AdjustTheVote.org website, you are agreeing to the following terms, including those available by hyperlink, (the "Agreement" or "User Agreement") with AdjustTheVote.com, AdjustTheVote.net and AdjustTheVote.org and links provided by our state and local affiliates.

Before you may become a member of AdjustTheVote.org, you must read and accept all of the terms and conditions in this User Agreement. . The AdjustTheVote.org User Agreement is always the agreement that appears in the footer of each page on the AdjustTheVote.org website.

This Agreement is effective on October 1, 2008, for current users, and upon acceptance for new users. The previous amendment to this Agreement was effective for all users on September 1, 2008.

Using AdjustTheVote.org

While using the Site, you will not:
  • post communications, or content that is inappropriate or contrary to the purpose of this Site (such as content that violates any law, third party right, and you may not list correspondence that promote or glorify hatred, violence, racial or religious intolerance, or promote organizations with such views);
  • use the Site if you are under the age of 18, or are temporarily or indefinitely suspended from AdjustTheVote.org;
  • post false, inaccurate, misleading, defamatory, or libelous content (including personal information);
  • take any action that may undermine purpose of this Site (such as displaying, importing or exporting communiqué for purposes unrelated to AdjustTheVote.org);
  • distribute or post spam, chain letters, or pyramid schemes;
  • distribute viruses or any other technologies that may harm AdjustTheVote.org, or the interests or property of AdjustTheVote.org subscribers;
  • copy, modify, or distribute content from AdjustTheVote.org's including copyrights and trademarks; or
  • harvest or otherwise collect information about users, including email addresses.

Abusing AdjustTheVote.org

Without limiting other remedies, we may limit, suspend, or terminate our service and user agreements, prohibit access to our website, delay or remove hosted content, and take technical and legal steps to keep users off the Site, if we think that they are creating problems, creating possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel user agreements that have been inactive for a long time.

AdjustTheVote.org and our affiliates work together to keep the Site working properly and the Site working uninterrupted. Please report problems, offensive content, and policy violations to us.

AdjustTheVote.org's web-site program works to ensure that listed content does not infringe upon the copyright, trademark or other rights of you or third parties. If you believe that your rights have been violated, please notify our AdjustTheVote.org’s immediately.

Fees

Chiropractors and Chiropractic Students:  Subscribing to AdjustTheVote.org as a chiropractor or chiropractic student as a Congressional and Legislative District Director (CDD/LDD) is free.

Chiropractic Patients and Chiropractic Supporters:  Subscribing to AdjustTheVote.org as a Patient (or Supporter) for Chiropractic Political Awareness (PCPA) is free.

State or Local Affiliates: Fees for use of AdjustTheVote.org are negotiated by separate agreement.  Affiliates must agree to the terms of this User Agreement.

Content License

IF you give AdjustTheVote.org content (e.g.: such as letterhead, signatures, photographs and/or personal logos) you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to exercise the copyright, publicity, and database rights you have in the content, in any media known now or in the future.

Liability

You will not hold AdjustTheVote.org responsible for other subscribers' actions or inactions, including things they post and/or forward to you.

You acknowledge that AdjustTheVote.org is not a traditional electronic messaging center and that you are subscribing to and becoming a non-voting, non-dues paying member of a legislative grass roots network organized by the International Chiropractors Association, a not-for-profit trade association of independent chiropractors.

You acknowledge that membership, as a subscriber to this Site, cannot inure to the benefit of any officer, director and/or member, including you, except for membership acknowledgement in the form of membership certificates.

You also acknowledge that no personal treatment, diagnosis or health care issue will be part of your AdjustTheVote.org record unless you personally convey that information to your respective legislator and for that information you will hold AdjustTheVote.org harmless.

As a subscriber, you acknowledge that you may opt-out of any further e-mail broadcasts by deleting or canceling your membership as a “Congressional District Director” or “Patient for Chiropractic Political Awareness”. Cancellation as a CDD or PCPA member will unsubscribe email broadcasts.

You acknowledge, the AdjustTheVote.org Site is a venue to allow anyone to correspond with their respective legislators on issues important to the chiropractic profession.

Further, we cannot guarantee continuous or secure access to our services, and operation of the Site may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of our Site. Some jurisdictions do not allow the disclaimer of liability or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Regardless of the previous paragraph, if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the total fees you paid to us in the 12 months prior to the action giving rise to the liability, and (b) $.01.

Release

If you have a dispute with one or more legislators, subscribers (CDD or PCPA) or affiliates (state or local chiropractic organizations), you release AdjustTheVote.org (and our officers, directors, members, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Access and Interference

AdjustTheVote.org contains robot exclusion headers. Much of the information on the Site is updated on a real-time basis and is proprietary or is licensed to AdjustTheVote.org by our Subscribers or affiliates. You agree that you will not use any robot, spider, scraper or other automated means to access the Sites for any purpose without our express written permission.

Additionally, you agree that you will not:
  • take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure;
  • copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for Your Information) from the Site without the prior expressed written permission of AdjustTheVote.org and the appropriate affiliate, as applicable;
  • interfere or attempt to interfere with the proper working of AdjustTheVote.org or any activities conducted on the Site; or
  • bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Site.

Privacy

We do not sell or rent your personal information to third parties for any marketing purposes. We use your information only as described in the AdjustTheVote.org Privacy Policy. We view protection of subscribers' privacy as a very important community principle. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. We use third parties to verify and certify our privacy principles. For a complete description of how we use and protect your personal information, see the AdjustTheVote.org Privacy Policy. If you object to your Information being transferred or used in this way please do not use our services.

Privacy Policy

    Collection
  • When you register or enter information on AdjustTheVote.org, we collect your personal information.
  • We may use cookies and other technology to keep track of your online interaction with AdjustTheVote.org.
    Use
  • We use the information to provide correspondence for you to your respective legislators.
  • We use the information to personalize AdjustTheVote.org for you, and to more effectively communicate between Patients for Chiropractic Political Awareness (PCPA), their sponsoring Congressional District Director (CDD), the International Chiropractors Association (ICA) and its Political Action Committee (PAC) and chiropractic state or local affiliates.
  • We use the information to help enforce our terms and conditions, to prevent fraud, and to keep the Site safe.
    Disclosure
  • We only disclose your information as allowed for communications between you, the people who sponsored you, those you sponsor and your respective legislators.
  • If you subscribe as a CDD (chiropractor) your name will be used as an auto-fill drop-down feature for your patients looking to enroll in your network.
  • We may contract with state or local affiliates (chiropractic organizations) who work on our behalf to help promote chiropractic legislative efforts on a state or local level.

Choices
  • To choose how we communicate with you, you may accept communications directly from the ICA or a local affiliate. Or, if you are a patient you or your doctor may elect to forward all communications through your personal chiropractor, if he/she is an active Congressional District Director (CDD).
  • To access, review, and change your personal information, go to your personal profile in AdjustTheVote.org.

Important information
  • We don’t send spam and do not permit spam on AdjustTheVote.org.
  • Keep your online identity safe. Whether you're on- or offline, give care for your password. If your password falls into the wrong hands, your identity may be stolen and someone else may access your personal profile. You can take a few simple steps to help ensure that your password is protected:
    • Make sure no banking, credit card, SSN or other financial information is posted to your personal profile.
    • Create a more secure password by using a combination of letters and numbers.
    • Change your password often.
    • Don't share your password with anyone.

Indemnity

You will indemnify and hold us (and our officers, directors, members, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

No Agency No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

Notices

Except as explicitly stated otherwise, membership termination shall be served on AdjustTheVote.org's national registered web-site by simply deleting your record from the AdjustTheVote.org's database (in the case of AdjustTheVote.org) or to the email address you provide to AdjustTheVote.org during the registration process (in your case). Notice for membership termination shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice of membership termination by mail to the address provided during the registration process. In such case, notice shall be deemed given three days after the date of mailing.

Additional Terms

The following policies are part of this Agreement and provide additional terms and conditions related to specific services offered on the Site:
  • Outage Policy - the AdjustTheVote.org site may occasionally experience an outage during which subscribers (CDDs and PCPA) cannot communicate effectively with their legislators. You will hold this Site harmless for any outage.
  • Prohibited, Questionable & Infringing Policy - Before you send correspondence or complete and use any template on this Site, you need to find out if your correspondence is allowed on AdjustTheVote.org and if the type of correspondence is subject to certain restrictions. As an CDD of PCPA member, you are ultimately responsible for making sure that any correspondence is consistent with the purpose of this Site and legal in the eyes of the law.
  • Investigations - AdjustTheVote.org tries to resolve reported cases of inappropriate CDD and PCPA member behavior. AdjustTheVote.org will consider the circumstances of an alleged breach of this agreement and the subscriber’s record before taking action. Disciplinary action may range from a formal warning up to indefinite membership suspension and denied access to AdjustTheVote.org.
Each of these policies may be changed from time to time. Changes take effect when posted on the Site. When using the AdjustTheVote.org Site, you are subject to posted policies or rules applicable at the time the Site is used. All such policies or rules are hereby incorporated into this Agreement.

General
  • Home office address:  AdjustTheVote.org is the registered domain name owned by the Political Action Committee of the International Chiropractors Association (ICA). The home offices are located at 6400 Arlington Boulevard, Suite 800, Falls Church, VA 22042, USA.
  • Severability:  If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
  • Headings:  Headings are for reference purposes only and do not limit the scope or extent of such section.
  • Breaches:  Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this Agreement.
  • Amendments to this Agreement:  In our sole discretion, we may amend this Agreement at any time by posting the amended terms on this Site. Notices will be posted under “Privacy Statement” and shall take automatically when posted. This Agreement may not be otherwise amended except in writing.
  • Entirety:  This Agreement sets forth the entire understanding and agreement between AdjustTheVote.org with respect to the subject matter hereof.
  • Survivability:  The following Sections survive any termination of this Agreement: Fees and Services (with respect to fees owed for our services), Release, Content License, Liability, Indemnity and Resolution of Disputes.
  • Suggestions/Complaint Form:  You may offer suggestions or report complaints by completing the attached complaint form.
